These Terms & Conditions (“Terms”) govern your access to and use of the RecyIndia website, mobile application, and related services (collectively, the “Platform”). By accessing, registering on, or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
If you do not agree with these Terms, you must not access or use the Platform.
1. About RecyIndia
RecyIndia is a technology-enabled digital marketplace designed to connect households, commercial establishments, institutions, waste vendors, scrap dealers, collection agents, and recycling factories for the listing, buying, and selling of recyclable waste materials and recycled products.
RecyIndia operates solely as a platform facilitator. RecyIndia does not directly collect, transport, store, recycle, dispose of waste, or manufacture recycled products, nor does it act as an agent, broker, partner, or guarantor in any transaction conducted on the Platform.
2. Eligibility & User Categories
The Platform may be accessed by:
Individual users (households)
Commercial establishments and businesses
Institutions (schools, colleges, hospitals, temples, offices, residential societies)
Waste vendors, scrap dealers, and collection agents
Recycling factories and processing units
By using the Platform, you represent that you are legally competent to enter into binding agreements under Indian law and that all activities conducted by you are lawful.
3. User Registration & Accounts
To access certain features, users must register and create an account. Users agree to:
Provide accurate, complete, and up-to-date information
Maintain confidentiality of login credentials
Be responsible for all activities conducted through their account
RecyIndia reserves the right to suspend or terminate accounts providing false, misleading, or incomplete information.
4. Platform Role & No Agency Relationship
RecyIndia:
Does not control pricing, negotiations, or transaction terms
Does not guarantee pickup, delivery, payment, quality, quantity, or legality
Is not responsible for service execution or user conduct
All transactions occur directly between users, and RecyIndia is not a party to such transactions.
5. Waste & Product Listings
Users listing waste materials or recycled products must ensure that:
Listings are lawful, accurate, and complete
Materials comply with environmental, safety, and waste-management regulations
Prohibited, hazardous, biomedical, or illegal materials are not listed unless explicitly permitted under applicable law
RecyIndia reserves the right to remove any listing that violates laws or platform policies.
6. Pricing, Payments & Transactions
Pricing is determined solely by users and vendors
RecyIndia does not control or influence pricing decisions
Payments, if facilitated, are processed via third-party payment gateways
RecyIndia is not responsible for payment delays, failures, chargebacks, or disputes
All financial arrangements are strictly between the transacting parties.
7. Vendor Verification
RecyIndia conducts document-based verification of waste vendors, scrap dealers, collection agents, and recycling factories during registration. This may include review of business documents, identity details, licenses, or address proofs.
Verification is conducted solely to enhance transparency and user trust. Verification does not constitute an endorsement, certification, warranty, or guarantee of services, pricing, quality, safety, legal compliance, or business conduct.
All vendors operate as independent service providers and remain fully responsible for their operations and regulatory compliance.
8. User Responsibilities
Users agree to:
Act ethically and professionally
Comply with applicable laws and regulations
Not misuse the Platform for fraudulent or illegal purposes
Resolve disputes directly with other users
9. Prohibited Activities
Users must not:
List illegal or restricted materials
Provide false or misleading information
Circumvent platform systems or safeguards
Harass, abuse, or threaten other users
Use the Platform for unlawful purposes
Violation may result in suspension or permanent account termination.
10. Disputes Between Users
All disputes, claims, or disagreements between users—including pricing, pickup, delivery, quality, quantity, payment, or compliance—must be resolved directly between the involved parties.
RecyIndia is not obligated to mediate or resolve such disputes.
11. Intellectual Property
All content on the Platform, including trademarks, logos, software, text, graphics, and design elements, are the property of RecyIndia or its licensors. Unauthorized use is prohibited.
12. Data Protection & Privacy
User data is handled in accordance with RecyIndia’s Privacy Policy. By using the Platform, users consent to data collection and processing as described therein.
13. Limitation of Liability
To the maximum extent permitted by law, RecyIndia shall not be liable for:
Direct, indirect, incidental, consequential, or punitive damages
Loss of profits, data, business, or reputation
Regulatory or legal non-compliance by users
Actions or omissions of third parties
Use of the Platform is at the user’s sole risk.
14. Indemnification
Users agree to indemnify and hold harmless RecyIndia, its founders, employees, affiliates, and partners from any claims, damages, losses, penalties, or legal actions arising from:
User activities on the Platform
Violation of these Terms
Legal or regulatory non-compliance
15. Platform Modifications & Termination
RecyIndia reserves the right to:
Modify or discontinue any part of the Platform
Introduce new services or pricing models
Suspend or terminate access for policy violations
16. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India.
